Power of sale arises when the holder of the mortgage will sell the dwelling (on which the loan re payments have been defaulted) without any jurisdiction of the legal courts. The borrower in this company is usually a traditional bank or a credit company that has expanded the loan to the property owner.
After the sale of the house is over, the mortgage holder will recover its dues, usually the unpaid portion of the mortgage loan. The first priority is always the lien holders, then the mortgage holders and finally the borrower if there is any remainder. 29 states in the US allow power of sale properties. This is the reason that many real estate listings will also have power of sale properties listings also.
Regulations are not the same across all states of the US.The states on the west coast that are Oregon, California and Washington allow for this approach. Further more Alaska and Hawaii also permit the power of sale property; listings. The procedure in which they are conducted may possibly differ slightly.
In California, the homeowner has the right to pay off the mortgage amount (the past due amount) and can even halt the procedure 5 days before the foreclosure proceeds take place. While in Oregon, the homeowner can rectify the problem any time before the foreclosure proceedings take place by making a payment for the defaulted mortgage amount.
The Eastern state and DC also allow this process of foreclosure. These include Georgia, New Hampshire, Massachusetts, North Carolina, Maryland and District of Columbia. While the sale of the property must be conducted at the court house in North Carolina, in New Hampshire all proceedings take place on the property itself.
Many other states such as Texas have a mandatory requirement that the foreclosure proceedings must start on a Tuesday only. This way they are able to have a greater control on the process and keep away from any unnecessary speed. A very rapid procedure can never be in favor of owner.
